Agreeing to these terms
These terms cover your use of the Carlsbad Concrete website and any estimate or concrete work you arrange with us. By using this site, starting from the home page, you agree to them. If you don't agree, please don't use the site.
When we do a job for you, the written estimate or contract you sign for that job also applies. If it says something different from these terms, the signed document controls for that job.
What we do
Carlsbad Concrete is a concrete contractor in Carlsbad, NM. We build driveways, patios, sidewalks, steps, garage floors, pool decks, retaining walls, footings and foundations, and we also do stamped and decorative work, foundation raising and concrete cutting.
The descriptions and photos on this site show the kind of work we do. They aren't a promise that your job will look exactly the same, because every slab depends on the ground under it, the layout of your property and the finish you pick. You can read more about who we are on our about page.
Estimates and pricing
Our estimates are free, done on site and come with no obligation. We come out because we need to see the ground, the slope and where the water runs before we can price a job honestly.
An estimate is based on what we can see that day. Things we can't see until the old concrete is out or the digging starts, like soft soil, old fill, roots or buried debris, can change the work and the price. If that happens, we'll explain it and get your approval before we do any extra work.
Nothing on this website is a price quote. Your price is the one written on your estimate, and it holds for the period stated there, since material costs can change after that.
Scheduling, weather and cancellation
We set a pour date with you once you approve the estimate. Heat, wind, rain or a freeze can push that date, because pouring in bad conditions makes a weaker slab, and we'd rather move the day than pour concrete that won't last.
If you need to cancel or reschedule, call us at (575) 266-8153 as early as you can. Once materials are ordered or forms are set, any cancellation charges are the ones listed in your written agreement.
New concrete needs time to cure, which is the wait while it hardens and gains strength. We'll tell you when it's safe to walk and drive on, and damage from using it sooner isn't covered by our guarantee.
Payment
Payment terms, including any deposit and when the balance is due, are written in your estimate or contract. Please read them before you sign so there are no surprises when the job wraps up.
If a payment is late, we may pause work or hold off scheduling the next stage until the account is current, as your agreement allows.
What we ask of you
Before we dig, please point out any sprinkler lines, private gas or electric lines, septic lines and property lines you know about, because we can't see what's underground on your side of the meter. You're also responsible for any approval your homeowners association requires.
We need clear access to the work area on pour day, and pets, kids and vehicles should stay off fresh concrete until we say it's ready.
Our guarantee and what it doesn't cover
We're fully licensed and insured, and our work is backed by our satisfaction guarantee. The details of any guarantee for your job are in your written agreement, and if something isn't right, call us and we'll come look at it.
Concrete can crack even when it's done right, because it shrinks as it cures and moves with the ground under it. We cut control joints, which are planned grooves that give cracks a place to form, so most cracks stay in those lines. Hairline cracks, small color differences between pours and surface wear from weather or normal use aren't defects.
Our guarantee doesn't cover damage from things outside our control, such as heavy equipment or loads the slab wasn't built for, deicing salts, changes to drainage or grading after we leave, tree roots, earth movement, flooding or work done by others.
Apart from what's written in your agreement, this website and its content are provided as is, without warranties of any kind, to the extent the law allows.
Limits on our liability
To the extent New Mexico law allows, Carlsbad Concrete isn't liable for indirect or consequential losses from your use of this website or from our work, such as lost use of your property or lost income. Our total liability on any job is limited to the amount you paid us for that job.
Nothing in these terms takes away a right you have under the law that can't be waived.
Settling a disagreement
If you have a problem, call us first, since most issues get fixed with a conversation and a visit to the site.
If we can't work it out that way, we both agree to try mediation in good faith before either of us goes to court. Any lawsuit will be brought in the courts that serve Carlsbad, New Mexico.
Which state's law applies
These terms and any work we do for you are governed by the laws of the State of New Mexico.
Changes to these terms
We may update these terms from time to time, and changes take effect when we post them here. The terms in place when you signed your agreement still apply to that job.
